Another major consideration has been the Travel Act, which is a federal law that aims to protect the traveler from unlawful gambling on interstate commerce. Essentially, this means that if a person uses an interstate casino or facility to conduct a gambling activity, the state in which the gambling takes place cannot prosecute them.

On the other hand, some have raised questions about the constitutionality of the law, arguing that the Act is unconstitutional because it would violate the free speech guarantees of the First Amendment. Interestingly, these arguments have been unsuccessful, primarily because of the fact that the nature of the business involved is commercial and does not raise concerns about the Commerce Clause.

Nevertheless, the Travel Act and the Illegal Gambling Business Act both make it unlawful for a person to use the Internet to commit an unlawful act. For instance, under the Wire Act, it is unlawful for a person to bet on a sporting event, or to participate in an online poker or bingo tournament.

In addition to the federal laws, states have the power to make their own rules regarding gambling. Currently, there are nine states in the USA that have enacted a gambling regulation, and each one has its own unique rules.
